Allen Owl was an Eastern Band Cherokee man

The common perception of why the Eastern Band of Cherokee Indians' ancestors remained in North Carolina after the Trail of Tears in the 1830s is that many of them hid in western North Carolina's mountains.

There were five circumstances during the early 19th century that contributed to the EBCI's ancestors remaining east.
1) Due to a conflict between the Meigs census of 1809 and the 1819 treaty, there were 1,065 North Carolina Cherokees whose land would be excluded from the CN.
2) The second was the North Carolina Cherokees who possessed proper certificates exempting them from removal.
3) The third circumstance is the North Carolina Cherokees who were members of Oochella's Band.
4) The fourth circumstance is the North Carolina Cherokees who resisted the removal, those who hid from the federal troops were dismissed by the War Department as not worth the trouble and expense to remove.
5) The fifth circumstance was the North Carolina Cherokees who escaped Indian Territory after being removed.

The Qualla Boundary or The Qualla is territory held as a land trust by the United States government for the federally recognized Eastern Band of Cherokee Indians (EBCI), who reside in Western North Carolina. The Cherokee and their ancestors have long occupied the area, having migrated there centuries before Europeans arrived. The Cherokee were forcibly removed in the late 1830s from much of this area. The Qualla Boundary is a land trust supervised by the United States Bureau of Indian Affairs. The land is a fragment of the extensive historical homeland of the Cherokee in the region and was considered part of the Cherokee Nation during the 19th century.

William Holland Thomas had lived and worked among the Cherokee people for a good portion of his life. He had a knowledge of their traditions and language and was close friends with some members of the tribe. The Cherokee valued and respected Thomas; he had studied law and was adopted into the tribe and named as successor by its hereditary chief. Thomas purchased lands around the Oconaluftee River for the tribe, the total area adding up to around 50,000 acres; the purchased lands are a large part of what makes up the Boundary today. The Cherokee organized and formed a corporation in 1870 to be able to purchase and hold additional lands.[4] The Cherokee who gained the ability to live in North Carolina were considered to be an independent band from the Cherokee Nation living in Oklahoma.

Biography:
Allen Owl was born February 26, 1890 in Cherokee Town, Swain County, North Carolina, to father Blue Owl and mother Quety Owl. He was supported in his Guion Miller application by his foster mother Margaret Standing Deer. Allan married Ella Rogers who was a negro woman, and had two children, Martha and Noah before being committed to the Canton Asylum in 1916.

Allen is said by Dr. Hummer to be the the father of Delores, daughter of Agnes Caldwell. "Employees (probably without Hummers knowledge) also allowed her (Agnes Caldwell) to help them with laundry work in the basement, undoubtedly so hard-pressed with their duties that they risked disobeying Hummer to allow Caldwell to work on her own. She and Allen Owl met in the basement about twice a week until he was discharged on October 26, 1920. Hummer told the commissioner that the ward attendants, Juel and Hewling, had left the facility too early for either of them to be the father of Caldwell's child; thus he deduced that it had to be Allen Owl.

From the book Vanished in Hiawatha, author Carla Joinson states that Allen was Cherokee, admitted on September 22, 1917 with no diagnosis, and discharged on October 26, 1920. She also states that while a patient/inmate, Allen was allowed to work for a farmer while at the asylum.

Allen's location of burial is in question. The death certificate says he was buried in the Birdtown Cemetery, Cherokee, Swain, North Carolina, but a survey on the burials here: https://sites.rootsweb.com/~nchaywoo/birdtowncemetery.htm does NOT identify him. He is NOT found in Find a Grave.
