Captain Hardin Burnley, son of John Burnley, was born November 21, 1703 New Kent County, Virginia; died prior to 1778 [5] in Hanover County, Virginia which was formed by a division of New Kent County, Virginia; he married 1)[6] and 2) Ann Winston (nee Terrill). Hardin was the son of John Burnley and _____ Hardin. Ann Winston (nee Terrill) was born about 1700 in Orange County, Virginia and is thought to be the daughter of Will Terrill and Patsey Winston of Orange County, Virginia.
A Louisa Co., VA Chancery court case 1871-022 - Burnley vs. Duke < link > proves the children and grandchildren of Hardin Burnley. This suit is a voluminous 1198 pages.
The child of Hardin Burnley and his first wife was:
- 1. Richard Burnley born about 1726 St. Paul's Parish, Hanover County, VA.; died prior to September 4, 1783; married July 26, 1772 Eliza Swann Jones St. Thomas Parish, Orange County, Virginia. Eliza survived Richard Burnley and was the administrator of his estate in 1785 Orange County, Virginia. Their children were: Nancy Ann Burnley & Mary Bell Burnley.
The children of Hardin Burnley and Ann Winston (nee Terrill) were:
- 2. John Burnley born about 1728 St. Paul's Parish, Hanover County, VA.; died at sea [2] February 1779. This is the John Burnley who left a will dated 1771 in Hanover County, Virginia. Then returned to England where he left another will dated October 26, 1778. In his Hanover County will [2] he mentions brothers Zachariah Burnley, Hardin Burnley, Richard Burnley and sisters Elizabeth Duke, Keziah Duke, Ann Littlepage and sons (David, James and William) of a deceased sister Judith Meriwether, who married James Meriwether. He did not mention a wife or children. John Burnley's brother Hardin Burnley qualified as executor for the London Will; and his brother Richard Burnley qualified for the Hanover County, Virginia will. Before Richard Burnley could settle his brother John Burnley's estate in Hanover County, Virginia; John died. The courts then appointed his brother Zachariah Burnley as executor to administer the settlement of the Virginia estate of John Burnley.
- 3. Zachariah Burnley born about 1730 St. Paul's Parish, Hanover County, VA.; died about 1800; married 1) unknown 2) 1759 Mary Bell Jones, widow of John Jones. Zach / Zachariah Burnley appears multiple times in the Orange Co., VA Road Orders. DAR Ancestor # A018123. Their children were: Mary Burnley, Hardin Burnley & Hardenia Burnley. Zachariah Burnley retired to his son Hardins estate where he died intestate.
- 4. Judith Hardinia Burnley born about 1732 St. Paul's Parish, Hanover County, VA.; died 1760 in Louisa County, Virginia; married 1753 James Meriwether in Louisa County, Virginia. Their children were: Ann Meriwether, David Meriwether, James F.Meriwether, & William Meriwether.
- 5. Hardin Burnley, Jr. born about 1741 St. Paul's Parish, Hanover County, VA.; died November 27, 1823 in London England, burial London; married 1759 Catherine Maitland. Their children were: William Hardin Burnley
- 6. Ann Terrill Burnley born about 1742 St. Paul's Parish, Hanover County, VA.; died 1822 Virginia; married 1764 Thomas Edmund Littlepage of King William County, Virginia. Their children were: Hardin Littlepage, Thomas Littlepage, James Beverley Littlepage
- 7. Elizabeth Burnley born about 1742 St. Paul's Parish, Hanover County, VA.; died prior to April 15, 1820; married __-1759 John Duke (born 1738) Hanover County, Virginia
- 8. Keziah Burnley born about 1743 St. Paul's Parish, Hanover County, VA.; died 1823; married James Duke (born 1740). James predeceased Keziah as she married Samuel Redd by 1803. Keziah and James Dukes children were: Hardin Burnley Duke, Keziah Duke, Cleavers Duke, James Duke & Amediah Dyer Duke.

In the Chancery notes at the bottom of page 24 for Captain Hardin Burnley it is stated that : "Richard Burnley was John's eldest brother of whole blood." This seems to infer that Richard and John Burnley's mother had died and the rest of Captain Hardin Burnley's children were half-brothers/sisters from a second wife. Since Ann Winston (nee Terrill) was a widow, it seems reasonable that Ann Winston (nee Terrill) was Hardin Burnley's second wife.
