28 January 1463-64: Charter under the Great Seal of Scotland by which James III, King of Scots, confirms possession of various lands to William, Lord Abernethy in Rothymay, who had previously resigned them in order to obtain a new grant. The lands in question, which included Rothymay in the Sheriffdom of Aberdeen, were to be held by Lord Abernethy and his lawful male heirs; who failing by his brother James of Abernethy and his lawful heirs; whom failing by his brother George Abernethy and his heirs; whom failing by his brother Archibald and his heirs; whom failing by his cousin John Abernethy and his heirs. John is identified as the son of Oswald Abernethy. In the event of the failure of all the heirs in remainder the lands in question were to pass to the nearest heirs of William, Lord Abernethy, bearing the Name and Arms of Abernethy. The lands in question, which included Rothymay in the Sheriffdom of Aberdeen, were incorporated by James III, King of Scots, as the barony of Abernethy. The barony was to be held by Lord Abernethy and his lawful male heirs; who failing by his brother James of Abernethy and his lawful male heirs; whom failing by his brother George Abernethy and his lawful male heirs; whom failing by the lawful male heirs of his deceased brother Archibald Abernethy; whom failing by his cousin John Abernethy and his heirs. John is identified as the son of Oswald Abernethy. In the event of the failure of all the heirs in remainder the lands in question were to pass to the nearest heirs of William, Lord Abernethy, bearing the Name and Arms of Abernethy.

James Abernethy, 3rd Lord Saltoun of Abernethy was the son of Laurence Abernethy, 1st Lord Saltoun of Abernethy and Margaret (?).[1],[2] He married unknown wife (?).[1] He died from 1504 to 1505.[1]
He gained the title of 3rd Lord Saltoun of Abernethy. On 10 October 1488 served heir but had a long lawsuit with the heirs of line till this settled by arbitration.[1]
